It occurs all the time, and much more frequently than what is reported on the news. And based on the information above, Florida is one of the leading states for malpractice cases. Why don't you hear about it to a greater extent on the news? If the client or patient has a really valid lawsuit, nearly all professionals will choose to settle out of court. Is it simply that they know they are wrong and don't want to have to put in all that court time? That may be part of it but the bigger reason is that if they settle out of court, they frequently do so with a gag order so that the client or patient will essentially shut up about it, and therefore the professional does not get the ton of bad publicity that they would if it ended up in court.

Does that make it right? Of course not, but residents must be more aware about the possibility of Florida malpractice happenings. As with any malpractice case, the burden of proof is to a greater extent on the client or patient than the doctor, dentist or lawyer, but in many situations that is not that difficult to prove. You should keep exact and detailed records of visits to doctors, dentists and lawyers with dates, names and description of what occurred.
